It is no longer news that Mr  John Unachukwu instituted an action against NBA to put to a halt the upcoming elections because he was disqualified for contesting the NBA elections.  

The judgment was scheduled to be delivered on 29 July,2016 just in time before the NBA elections. The judgment which was delivered by Justice Adeniyi lasted for two hours. The court in striking out the suit upheld the argument of the defendants that the plaintiff was not the person disqualified by its electoral Committe from contesting. The court also held that the three names to wit John Echezona Unachukwu, John Unachukwu Austin and Unachukwu John Austin were radically different from one another.

The judgment paved way for the 2016 NBA elections which held on 30 July, 2016.
